1. Agreement to Terms

By accessing or using The Time Anchor ("Service"), operated by The Time Anchor Sp. z o.o. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

The Time Anchor provides a letter delivery service that allows users to create, schedule, and send physical or digital letters to be delivered at a future date. Our services include:

• Digital letter creation and formatting
• Printing and physical mail delivery through postal services
• Digital letter delivery via email
• Secure storage of letters until delivery date
• Tracking and delivery notifications

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Age Requirements

You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Letter Content and Acceptable Use

4.1 Your Content

You retain all rights to the content of your letters. By using our Service, you grant us a limited license to:

• Store your letter content securely
• Print and deliver your letters as instructed
• Display your content for preview purposes

4.2 Prohibited Content

You agree not to create or send letters containing:

• Illegal, harmful, threatening, abusive, or harassing content
• Defamatory, vulgar, obscene, or invasive content
• Content that infringes intellectual property rights
• Spam, chain letters, or pyramid schemes
• Malware, viruses, or harmful code
• Content that violates any applicable laws

5. Payment Terms

5.1 Pricing

• Physical letters: £9.99 for the first page, £0.25 per additional page, £0.50 per year for storage
• Digital letters: Free
• Letters can be scheduled up to 50 years in the future
• Physical letter prices include printing, premium envelope, secure storage, and Royal Mail 1st Class UK delivery

5.2 Payment Processing

Payments are processed securely through Stripe. We do not store your payment card details. By providing payment information, you authorize us to charge the applicable fees.

5.3 Refunds

You may cancel and receive a full refund within 14 days of payment. After 14 days, you can still cancel your letter at any time before delivery, but refunds will not be provided. Once a letter has been sent for printing or delivery, cancellations and refunds are not available.

6. Letter Delivery

6.1 Delivery Timing

We make reasonable efforts to deliver letters on or near the scheduled date. However, we cannot guarantee exact delivery dates due to factors beyond our control, including:

• Postal service delays or disruptions
• Incorrect or incomplete addresses
• Force majeure events
• International customs processes

6.2 Undeliverable Letters

If a physical letter is returned as undeliverable, we will attempt to contact you for updated information. We are not responsible for letters that cannot be delivered due to incorrect recipient information.

7. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by The Time Anchor Sp. z o.o. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

9. Disclaimers and Limitations of Liability

9.1 Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation of Liability

To the maximum extent permitted by law, The Time Anchor Sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9.3 Maximum Liability

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless The Time Anchor Sp. z o.o., its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. Scheduled letters will still be delivered unless specifically cancelled.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
